Terms of Service

The short version
- You own everything you upload — we never take ownership of your work.
- You give us a license to host and stream it so the site can work; it ends when you take the work down.
- You must actually have the rights to what you post — including every music track.
- We can remove content or suspend accounts that break these rules.
- You must be at least 13; under 18 needs a parent's permission.
- Texas law governs, and disputes go to Travis County.
Little Indie Films (littleindiefilms.com and its subdomains, the “Service”) is operated by Scratchmade LLC (“we”, “us”). By creating an account or using the Service you agree to these terms.
1. Who can use the Service
You must be at least 13 years old. If you are under 18, you may only use the Service with the permission of a parent or legal guardian, who agrees to these terms on your behalf. Filmmaker and organization accounts are created by invitation. Payment features — receiving patronage, selling access to your work, and running fundraising campaigns — require the payment account holder to be at least 18, because our payment provider requires account holders to be adults. If you are under 18, a parent or legal guardian may hold the payment account for you: they verify their identity with the payment provider, receive all payouts on your behalf and hold them for your benefit, and are responsible for the account and for any taxes on the income. We may suspend payment features if we have reason to believe the account holder is not the filmmaker’s parent or legal guardian.
2. Your content stays yours
You retain full ownership of everything you upload — films, trailers, scripts, treatments, stills, artwork, and text. We claim no ownership interest in your work, ever.
So that we can operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transcode, display, and distribute your content — solely for the purpose of running and promoting the Service (for example: streaming your film to visitors, generating thumbnails, watermarking protected scripts, or featuring your work on an organization channel you submitted it to). This license ends when you remove the content or delete your account, except for cached copies and backups, which lapse in the ordinary course.
3. Your responsibilities for your content
By uploading content, you represent and warrant that:
- you created it or have the rights to publish it;
- you have secured any required third-party rights — including music licenses, appearance/model releases, and location permissions;
- it does not infringe anyone’s copyright, trademark, privacy, or publicity rights;
- festival laurels, awards, and credits you display are truthful.
4. Acceptable use
You may not use the Service to:
- upload content you do not have the rights to share;
- post unlawful, hateful, harassing, or sexually exploitative material, or any content sexualizing minors;
- impersonate another person or organization;
- circumvent protections on other members’ content (including watermarked scripts);
- spam, scrape, or interfere with the Service’s operation.
5. Moderation and removal
Uploading content does not transfer ownership to us — but we may remove content or suspend accounts at our discretion if we believe content is illegal, infringing, or violates these terms or our Community Guidelines. To report content, see the reporting process in the Guidelines. Copyright complaints are handled under our DMCA policy; repeat infringers will have their accounts terminated.
6. Accounts and security
Sign-in is by email link, Google, or a password held by Google’s identity service — we never see or store passwords ourselves. You are responsible for the email account you register with, and for activity on your site by admins you invite.
7. The Service is provided “as is”
The Service is provided without warranties of any kind, express or implied. We do not guarantee uninterrupted availability or that content will be preserved — keep your own masters and backups of your work.
8. Limitation of liability
To the maximum extent permitted by law, Scratchmade LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.
9. Indemnification
You agree to indemnify us against claims arising from content you upload or your breach of these terms — including claims that music, footage, or other material in your work was used without permission.
10. Changes and termination
We may update these terms; material changes will be announced on the Service. You may delete your account at any time. Sections 2 (license wind-down), 8, and 9 survive termination.
11. Governing law
These terms are governed by the laws of the State of Texas. Venue for disputes is Travis County, Texas.
